Major Losses in Latin America - claims and underwriting issues
A large complex loss in Latin America can be the beginning of an arduous (re)insurance claims process. HFW hosted a seminar to explore some of the more challenging issues facing parties involved in both non-marine and marine insurance claims emanating from Latin America, as well as pitfalls for underwriters of risks in the region.

The seminar was chaired by HFW Partner Paul Wordley and speakers included, HFW Partners Jonathan Bruce and Rebecca Hopkirk and HFW Senior Associate Geoffrey Conlin.
During the seminar, the speakers looked at typical issues faced by reinsurers in major losses in the region generally such as aggregation, claims control/co-op, causation, as well as specific problems in the region, including issues of local law and court jurisdiction/arbitration, fronting problems, different disclosure obligations, notification and time bar traps, currency issues, moral damages and recovery of costs. Reference was made to the significant jurisdictions including Brazil, Chile, Colombia, Mexico and Argentina.
