In a recent decision of the UK Supreme Court in Republic of Mozambique (acting through its Attorney General) v Privinvest Shipbuilding SAL (Holding) and Others [2023] UKSC 32, the Republic of Mozambique has won a long running battle on a preliminary issue concerning a stay under s.9 of the Arbitration Act 1996 (the 1996 Act). The win for Mozambique ends the stay and means the trial on the substantive issues can proceed.
