About Neil
Neil is a commercial litigator who specialises in complex cross-border litigation, including matters which involve claims for breach of contract, fraud and/or breach of fiduciary duties and asset tracing. His focus is on fraud and insolvency litigation, his skills in which have been developed in both HFW’s London and Melbourne offices.
Neil Chauhan is based in the London office and is also BVI qualified.
Neil also acts in an advisory capacity on non-contentious insolvency matters, for example on directors’ duties, company law, enforcement of debt/security, commercial contracts and asset realisation.
Neil has experience in off-shore jurisdictions, including the BVI and the Isle of Man.
Recent work includes:
The Serious Fraud Office and Anor v. Litigation Capital Limited and Ors: acting for the liquidators of various BVI and Isle of Man companies in respect of their tracing claims to shares and assets across the globe. The litigation, which is still ongoing, involves 27 parties and a 10-week trial in the Commercial Court is due to commence in January 2021.
Unicorn Worldwide Holdings Limited and others v. Cochrane and another: acting for the joint liquidators of various related companies in respect of their eight-figure claims for knowing receipt and breach of fiduciary duties. The litigation commenced in the British Virgin Islands however the joint liquidators also successfully applied for a worldwide proprietary and freezing injunction against the defendants in England.
2018 ad-hoc arbitration: acting for the Respondent in an international arbitration concerning issues of joint-venture financing in Sierra Leone and England. Advising on matters including asset tracing and sanctions.
