Welcome to our inaugural edition of the Offshore Wind Magazine. In this edition and in future editions, we will provide concise and user-friendly updates on the recent legal and contractual developments in the offshore wind industry.
Our construction lawyers have considerable experience in offshore wind and have advised some of the large offshore wind farms globally by turbine count and turbine size, as well as technology projects such as suction bucket jacket foundations and 66kV cabling.
In this edition, Richard Booth reviews the new IMCA T&I Contract and the allocation of risk under that Contract, specifically relating to the issues of vessel availability and defect correction. Richard Rowlatt considers developments in the UK Offshore Wind Market based on announcements by the new Labour government. Arpan Gupta summarises the decision of the English TCC court in Van Elle v Keynvor Morlift, where the Court provided guidance in relation to the applicability of the Construction Act to offshore works.
