Consultants’ Liability for Negligent Tender or Post-Tender Design Services

Contractors often rely on outline design to price and programme tenders. 

The design may be provided as part of the tender pack, or the Contractor may engage consultants to prepare the design for the purpose of preparing its own tender return. In both scenarios the Contractor is relying on that design to submit its tender for the works. 

In this seminar, we will explore what options are available to a contractor if the tender design turns out to be flawed such that the construction works are more expensive or time-consuming to complete than originally expected.

We will also consider whether a contractor has any remedies against a consultant if the design is provided late during the construction works and the best strategy for managing such a scenario.
