International Arbitration Webinar Series 2026: Strategic Advantage in Construction Arbitration: Managing Cost, Time and Outcomes
Please join us for an upcoming seminar in our International Arbitration Seminar Series 2026, where our speakers will explore the theme: Strategic Advantage in Construction Arbitration: Managing Cost, Time and Outcomes.
Arbitration is often viewed as a rigid, lengthy and expensive process – a “one size fits all” mechanism that runs its course once a dispute arises. In practice, however, arbitration offers significantly more flexibility than many parties realise. When approached strategically and proactively, it can be shaped to align with commercial objectives, manage risk more effectively, and drive better outcomes.
In this session, we will examine how parties can take greater control of the arbitration process, from the outset of contractual negotiations through to the conduct of proceedings and final hearing. Drawing on experience from major construction disputes, we will highlight practical strategies to secure advantage, manage pressure points, and reduce time and cost exposure.
Our speakers will cover key themes including:
- Using arbitration strategically, rather than treating it as a standardised process
- Embedding advantage at the contract drafting stage, including dispute resolution clauses
- Pre-arbitration steps to strengthen position and improve settlement prospects
- Key tactical considerations at the commencement of arbitration
- Managing documents, evidence and experts to control cost and timelines
- Creating leverage and applying pressure at critical stages of the proceedings
- Practical approaches to achieving efficient and commercially aligned outcomes
