Wednesday 08 October 2025

We are delighted to invite you to our panel discussion: Grounds for Dispute: Managing Unknown Site Conditions.

Unknown site conditions, and particularly ground risk, often cause disputes on construction projects.

In this session, we will explore appropriate risk allocation for ground risk, consider the potential routes a contractor might take to recovering time and costs under different contracts, and highlight common challenges faced by parties pursuing or defending these sorts of claims.

The discussion will consider the following kinds of issues:

  • Risk allocation for site conditions on different types of construction projects
  • Using contractual ‘relied-upon information’
  • Recovery routes (and how the route taken might impact on quantum)
  • Evidencing and defending site conditions claims

Networking drinks will follow the discussion.
