The Sanchez test has the potential to radically reduce the number of claimants who qualify as Jones Act seaman and increase the number of workers whose exclusive remedy is limited to the Longshore & Harbors Workers' Compensation Act. Dealing with Maritime Regulatory Issues in Asia Pacific
Dubious Vessel Detentions in Asia – when is a payment not a bribe?
The issue of vessels being detained off the coast of Indonesia in particular is a live issue and may prove challenging for parties to navigate. The presentation will address the issue of where payment is made in an attempt to release the vessel and/or crew, and whether this will fall foul of anti-bribery legislation. The presentation draws on HFW's recent experiences and in particular touches on the applicability of the Bribery Act 2010.

Ambiguity of arbitration clauses – the undecipherable and the pathological
Ambiguous arbitration clauses have the potential to cause a great deal of confusion for parties who value and require clarity when engaging in arbitration proceedings. This presentation aims to address situations where parties fix the terms of a charterparty in a fixture recap and the terms vary from the pro forma charterparty attached, particularly in the context of the seat and venue of the arbitration. The presentation will also cover situations where the arbitration agreement refers to procedural rules which do not exist, and how this will likely be resolved in light of recent caselaw.
