In the first of our 2016 Ports & Terminals seminars, HFW Partner Craig Neame and Associate Matthew Wilmshurst will be presenting on cargo claims against terminal operators.

Summary

In this talk, we will be reminding ourselves of the ways in which cargo interests can seek to bring claims against terminal operators for breach of contract, in tort and for breach of bailment. We will then look at how terminal operator's standard terms and conditions can help defeat such claims and how terminal operators can contract with shipping lines using bespoke agreements to help protect themselves. We finish by examining how other carriage contracts may be of assistance to cargo operators in defending claims of that nature.
