Legal Professional Privilege is under attack: what can we expect and what can we do?

In recent weeks, the head of the SFO expressed his determination to 'bring to heel' companies using LPP to obstruct investigations, the Public Accounts Committee has recommended criminalising 'aggressive' tax avoidance, and MPs have advocated strict liability penalties for professionals 'enabling' tax avoidance. In the light of these developments and HFW's recent experiences of dealing with competent authorities, officeholders and regulators, the scope for more iniquity exception challenges to LPP seems inevitable.

HFW Partners James Clibbon and Pierre-Olivier Leblanc, Senior Associate Iris Vögeding, and Associate Josianne El Antoury will discuss UK, French and German perspectives, and what practical steps might be taken to protect and preserve LPP before and during investigations or Court proceedings.
