HFW Seminar: Liens and interceptions - The BULK CHILE
HFW Senior Associate Richard Strub will be giving a presentation looking at the law and practicalities in relation to charterparty liens on sub-freight/sub-hires.
Date
13 May 2014
Location
Geneva
Summary
During the seminar Richard will discuss the above, with particular reference to the recent judgment of Dry Bulk Handy Holding Inc v Fayette International Holdings Ltd (the BULK CHILE), which considered the ability of a shipowner who has not received hire from his time charterer to intercept freights/hires payable between parties further down the charterparty chain and also from shippers under the bill of lading.
The decision in the BULK CHILE is somewhat controversial, and the seminar will examine the legal basis and nature of the above rights, providing practical assistance and guidance both for those issuing lien notices and those receiving them.
