Fergus is a Senior associate based in HFW's Hong Kong energy and resources group where he acts for a range of banks and other financiers, traders, private equity and other funds and insurers in the international trade and commodities sector.
He specialises in dispute resolution and has extensive experience of complex, multi-jurisdictional litigation and arbitration disputes, including disputes involving shareholders agreements, joint-venture agreements, investment and funding agreements, bilateral and syndicated loans, repo transactions, letters of credit, bills of exchanges, derivatives and spot and long term commodity sale and purchase contracts as well as charterparty and bill of lading disputes.
His experience includes cases involving fraud, arbitrations under the SIAC, HKIAC, LCIA, ICC, UNCITRAL and LMAA rules, as well as managing litigation, including asset tracing and enforcement, in a large number of jurisdictions including the PRC, Hong Kong and Indonesia. He also regularly advises on insolvency and restructuring issues within the sector and has acted for creditors and IPs in high profile insolvencies in Hong Kong and elsewhere.
Fergus also advises on environmental regulatory issues, with a particular focus on oil and coal, including on risk management and related issues.
Fergus is qualified in England and Wales and Hong Kong and is a member of the HK45 committee of the HKIAC and also a member of IWIRC. Before joining the Hong Kong office, Fergus worked in HFW's London and Piraeus offices and has also been seconded to the firm's Singapore office.
